Rumpus Terms of Use

The short version
- Be decent. No harassing anyone, and don't use Rumpus to watch people who haven't agreed to it.
- You need to be 13 or older and follow Discord's rules too.
- It's a free app run by one person on one computer. It can be wrong, late or offline, and it can change or stop.
- Paid features might come later through Discord. There's nothing to buy now.
- You can leave any time. I can remove people who break these rules.
- Tennessee law applies.
1. What this is
These are the rules for using Rumpus, a Discord app for friend groups. Rumpus is run by one person, David Windle Jr., in Tennessee, USA. In these terms, "I" and "me" mean that person.
By using the app (running /optin, or any other command, or pressing one of its buttons), you agree to these terms and to the Privacy Policy. If you don't agree, don't use it. You can leave any time (see section 9).
Rumpus isn't made by Discord and Discord doesn't endorse it.
2. Who can use it
- You have to be 13 or older. The app asks you in
/optin. If you're not 13, don't use it. - In some places the minimum age is higher than 13. If you live in one, that age applies to you.
- You have to follow Discord's Terms of Service and Community Guidelines. If Discord has banned you, you can't use the app.
- If you're under 18, ask a parent or guardian before you use it. In some places you need their OK to agree to terms like these.
3. How it works
You opt in, and you choose what to share and who can see it (see the Privacy Policy). You're in charge of your own settings. You're also responsible for who you put in your circle and who you invite to plans.
The app tries to follow your choices. It can still get things wrong, so don't share anything you'd be upset to have seen by the people in your circle.
4. Rules for using it
Don't:
- Harass, bully, threaten or pressure anyone with the app. That includes alerts, plan invites and cards.
- Use the app to watch someone who hasn't agreed to it. Everyone in your circle opted in on their own. Don't push someone to share, to add you to their circle, or to turn off a privacy setting. If someone leaves you out of their circle or turns off alerts, that's their call.
- Try to get around anyone's privacy settings: circles, the invisible rule or the 13+ check.
- Share what you see about other people (their check-ins, when they're around, their usual times, their cards) outside your circle. It was shared with you, not with the world.
- Use anything the app shows you about people to make decisions about their jobs, housing, credit or insurance, or to treat anyone unfairly because of who they are.
- Put anything illegal, hateful, or private about someone else in a check-in note, a plan title, or any other text you type. That means things like full names, addresses and phone numbers.
- Break Discord's rules while using the app.
- Attack the app. No hacking, overloading, copying its data, running it from automated or "self-bot" accounts, or flooding it with commands, alerts, plans or invites.
- Collect, sell or pass on other people's data from the app.
- Use the app for anything illegal.
If you run a server: only add the app to servers you're allowed to add it to. Don't pressure members to opt in, or to join a leaderboard if you switch them on. Both are each person's own choice.
5. What you put in
You keep what you type: check-in notes, plan titles, and so on. You give me permission to store it and show it to the people you chose, only so the app can do its job. I can remove anything that breaks section 4.
6. Other people's choices
Other people share things with you because they trust you. Respect their circle, their quiet hours, their snoozes and their "no". If someone asks you to stop setting alerts on them or inviting them to things, stop.
7. It's provided as-is
Rumpus is a free app run by one person. It runs on a computer at my place, not a big server. So:
- It can be offline. If the computer is off or asleep, the app is down.
- It can be wrong. "Usually free" is a guess. "Online" doesn't mean someone is free.
- Alerts, reminders and recaps can be late or never show up.
- Don't count on it for anything important, urgent or about safety.
I'm not promising it will work, be available, or be right. It's provided "as is".
8. Changes and shutdown
I can change the app, add or remove features, or change limits any time. I can also stop running it. If I do, I'll tell people if I can, and I'll delete the data the app holds. If I move it to a new host, the Privacy Policy explains how you'll be told.
9. Paid features later
I might offer some features for a price later, through Discord's Premium Apps. There are no prices today and nothing to buy. If that ever happens, you'd buy through Discord, and Discord's payment terms and refund rules would apply to the purchase. I'll update these terms and tell you before any paid feature starts.
10. Ending things
You can stop any time. Use /optout to pause in a server, /forget-me to delete your data, remove the app from your apps, or just stop using it. (See the Privacy Policy for what each does.)
I can pause or block anyone who breaks these rules or hurts other people, without warning if it's serious. I may also report abuse to Discord. If I block you, you can still ask me to delete your data.
Sections 5, 7, 11 and 12 keep applying after you stop.
11. Limits on what I'm responsible for
In plain words: I'm one person making a free app. To the most the law allows:
- I'm not responsible for losses that come from using the app. That includes a missed hangout, hurt feelings, something another person does with what you shared, or something lost when the app is offline.
- I'm not responsible for indirect or knock-on damages, like lost income or lost opportunities.
- If I'm ever responsible to you anyway, the most I'd owe is $100 or what you paid me in the last 12 months, whichever is higher.
Some places don't allow some of these limits. Where that's true, the limits apply as far as the law lets them. Nothing here takes away rights you have by law that you can't give up.
12. Law and disputes
Tennessee law applies to these terms. If we can't settle something by talking, it goes to the state or federal courts located in Tennessee. Please contact me first at #support in the Rumpus Discord server (https://discord.gg/9sBxqRvvZa) and give me a chance to fix it.
13. Changes to these terms
When I change these terms I'll change the date at the top. For big changes, I'll tell you before they start, with a notice in the Rumpus support server (see section 14). If you keep using the app after the date, you're agreeing to the new terms. If you don't agree, stop using it.
14. Reporting and contact
Contact me at #support in the Rumpus Discord server (https://discord.gg/9sBxqRvvZa) to ask a question, report someone misusing the app, report a bug, or ask me to delete your data. I read every report and act on it. For anything private, just post "DM me" there and I'll message you, so nothing personal goes in a public channel.
15. The small print
These terms and the Privacy Policy are the whole deal between us about the app. If part of these terms can't be enforced, the rest still stands. If I don't enforce something right away, I haven't given up the right to.
